The trademark framework in Pakistan
Trademarks in Pakistan are governed by the Trade Marks Ordinance 2001 and the Trade Marks Rules, administered by the Intellectual Property Organization of Pakistan (IPO-Pakistan) through the Trade Marks Registry. The Ordinance provides for the registration of marks across the classes of goods and services (following the international Nice Classification), the examination and publication of applications, opposition by third parties, and the rights and remedies of the registered proprietor. Registration confers the exclusive right to use the mark for the goods or services covered and the right to sue for infringement, while unregistered marks have only the more limited protection of a passing-off action. Pakistan's framework also recognises well-known marks and aligns with its international obligations.
Searches, applications, and registration
The path to a registered trademark begins with a clearance search to check that the proposed mark is available and not conflicting with existing registrations, followed by a properly drafted application in the correct classes.
